Supreme Court takes up detention of immigrants without bond hearings
The government asked the Court to take a different case on the same question, and the Court granted this one without stating reasons.
A difficult, precarious, or entrapping position, a predicament. 1
Quagmire began as a bog, from the obsolete quag plus mire, and was in English by the 1570s 2 (Merriam-Webster dates the first use to 1566 1). The figurative sense, an inescapable bad position, is recorded by 1766 but is missing from the 1897 Century Dictionary. It came back in 1965, narrowed to American military stalemates, after David Halberstam titled his book on Vietnam The Making of a Quagmire 2. Kirkus reviewed it that June and noted that his reporting from Saigon for The New York Times “ran counter to our official line of ‘cautious optimism’” 3. Merriam-Webster’s own example sentence is Donald Rumsfeld in 2003, laughingly dismissing the idea that Iraq was, or could turn into, a quagmire 1. On September 30, the day the Pentagon announced the end of its Iraq mission, the Associated Press quoted President Trump at a White House event: “It was a quagmire.” 4
Supreme Court grants review of mandatory immigration detention
On October 1 the Supreme Court granted review in Rhoney v. Barbosa da Cunha, No. 26-104. The order states no reasons and records no dissent 5. The case asks whether the government may detain immigrants apprehended inside the United States, some of whom have lived here for years, without a bond hearing while deportation proceedings continue. SCOTUSblog reports that the government applied that mandatory-detention provision to such people only since last year, and that district judges have ruled against the policy more than 9,300 times by Politico’s count 6. The government itself asked the Court to take a different petition, Lopez-Campos, as the better vehicle, and the Court “took up the issue, but not the administration’s preferred case” 6. Eight appeals courts besides the Second have ruled as it did, Roll Call reports, while the Fifth and Eighth sided with the administration, and the full Second Circuit declined to rehear this case 7. Argument is expected early next year, with no date set.
Gov. Lee halts Tennessee’s last 2026 execution after Christa Pike’s failed lethal injection
The Tennessee Department of Correction said on the night of September 30 that it had followed every step of its protocol and that Christa Pike had been taken to an off-site medical facility 8. The statement does not say whether she was alive or what went wrong. Her lawyers and the media witnesses say she was alive and snoring after the second dose 9 10. The Supreme Court had vacated a Sixth Circuit stay that day, with Justices Sotomayor, Kagan and Jackson dissenting 11. On October 1 Governor Lee ordered “a comprehensive, third-party review to determine exactly what occurred” and said the one other scheduled execution will not take place this year. His written statement is not on tn.gov, so those words are AP’s, as NPR carried them 9. The Nashville Banner names the other execution as Gary Wayne Sutton’s, set for December 3 10. Robin Maher of the Death Penalty Information Center called Pike’s case “singular and unparalleled”: seven people have survived failed vein access, she said, but none had stayed alive after the drugs 9. Pike’s lawyers told NBC she was in critical condition on Thursday afternoon, though neither lawyer quoted had seen her 12. No record yet says why the execution failed or what the review will cover.
U.S. ends Operation Inherent Resolve in Iraq with its departure from Erbil
Central Command said U.S. forces and equipment completed their orderly departure from Erbil Air Base on September 30, ending Operation Inherent Resolve in Iraq, which the Pentagon calls a 12-year campaign. Adm. Brad Cooper said Iraqi forces, including the Peshmerga, can “unilaterally manage threats to their homeland.” The CENTCOM release sits behind an access block, so that wording comes from Military.com and Task & Purpose, whose quotes match 13 14. AP reported the announcement as completing the withdrawal of all American troops 15. The Pentagon says it will keep providing “targeted training and intelligence support” 13, and a U.S. official declined to say how many personnel remain, citing operational security 14. A 2024 U.S.-Iraq joint statement had set the end of September 2025 as the latest date for the coalition’s mission in Iraq, a year before this exit 16. Prime Minister Ali al-Zaidi called the withdrawal “complete and final” on October 1 and promised a roadmap for weapons outside state control that will not extend beyond June 30, 2027, in an unofficial translation of his statement 17. The Kurdistan Region’s Peshmerga Ministry called leaving “without the provision of a defense system” a “matter of concern” 15.
Google releases Gemini 4 Argon to trusted cyber defenders first
Google announced Gemini 4 Argon on September 30 and is giving access only to trusted cyber defenders through its Fairwind Program. Wider access comes “as soon as possible,” starting with paid API customers and Google AI Ultra subscribers, with no release date 18. TechCrunch reports the same limited rollout and attributes the benchmark claims to Google 19. Google reports 77.9% on DeepSWE v1.1 and first place on AutomationBench at 51.3%. Two outside evaluators rank it differently. On the Vals Index, which Google cites, Argon is first at 68.90%, 1.86 points ahead of Claude Sonnet 5.5 20. Artificial Analysis puts it eighth of 224 on its Intelligence Index, at 53, below the Claude Opus 5.5 variants 21. Google’s claim of over 300 TiB of memory freed once rolled out, and its 2.7x decoder speedup, come from its own teams and have no outside confirmation. The post links no model card.
Cloudflare publishes Clef and Clef-flash decision models with open weights
Cloudflare released two decision models on October 1, Clef and Clef-flash, which return typed answers with probabilities instead of text. They run on Workers AI, and the weights are on Hugging Face under Apache 2.0 22. Cloudflare’s tables show Clef highest on four of ten shortlisted benchmarks and Clef-flash on three. Those are Cloudflare’s own runs, and The Register reports they “have yet to be reproduced for ranking on the official Decision Index” 22 23. The post says its models beat the field on latency except Laya, but its own table has Clef’s 209.3 ms median behind DiffusionGemma Jev at 84.4 ms and Kev-9B at 51.4 ms. Only Clef-flash, at 38.8 ms, is faster than both 22. “Open” here means open weights, since Cloudflare confirmed to The Register that the training datasets are not public 23.
